Agreement to Our Legal Terms

We are Adilet Bekmolda, doing business as MyMentra, a company registered in Kazakhstan at Microdistrict Shugyla 342/7, Almaty city, Almaty 050027.

We operate the website https://mymentra.app (the "Site"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

MyMentra is an AI-powered university admissions mentor that helps students navigate the application process. It provides personalized guidance on extracurricular activities, essays, scholarships, timelines, and university selection based on each student's profile and goals.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Adilet Bekmolda, concerning your access to and use of the Services. By accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

We will provide you with prior notice of any scheduled changes to the Services you are using. The modified Legal Terms become effective upon posting or notifying you by email. Continued use of the Services after the effective date of any changes means you agree to be bound by the modified terms.

The Services are intended for users who are at least 13 years of age. Minors (generally under 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Services.

1. Our Services

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation. Those who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws.

The Services are not tailored to comply with industry-specific regulations (HIPAA, FISMA, etc.). If your interactions would be subjected to such laws, you may not use the Services.

2. Intellectual Property Rights

Our intellectual property

We are the owner or licensee of all intellectual property rights in our Services, including source code, databases, functionality, software, designs, text, photographs, and graphics (the "Content"), as well as trademarks, service marks, and logos (the "Marks"). Our Content and Marks are protected by copyright and trademark laws and treaties around the world. The Content and Marks are provided "AS IS" for your personal, non-commercial use only.

Your use of our Services

Subject to your compliance with these Legal Terms, including the "Prohibited Activities" section, we grant you a non-exclusive, non-transferable, revocable license to access the Services and download or print a copy of any portion of the Content to which you have properly gained access, solely for your personal, non-commercial use.

Except as set out in this section, no part of the Services and no Content or Marks may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose without our express prior written permission. Any breach of these Intellectual Property Rights will constitute a material breach of these Legal Terms and your right to use our Services will terminate immediately.

Your submissions and contributions

Submissions: By sending us any question, comment, suggestion, idea, or feedback about the Services ("Submissions"), you agree to assign to us all intellectual property rights in such Submission, and we may use it for any lawful purpose without compensation to you.

Contributions: The Services may invite you to chat, comment, or otherwise create and submit content ("Contributions"). Contributions may be viewable by other users and through third-party websites, and may be treated as non-confidential and non-proprietary.

By posting Contributions, you grant us an unrestricted, irrevocable, worldwide, royalty-free license to use, copy, reproduce, distribute, publish, translate, and exploit your Contributions for any purpose, and to prepare derivative works of them. You are solely responsible for your Submissions and Contributions and agree to reimburse us for losses arising from your breach of this section, third-party intellectual property rights, or applicable law.

We may remove or edit any Contributions at any time without notice if, in our reasonable opinion, they are harmful or in breach of these Legal Terms, and may suspend or disable your account as a result.

3. User Representations

By using the Services, you represent and warrant that: (1) all registration information you submit is true, accurate, current, and complete; (2) you will maintain the accuracy of such information; (3) you have the legal capacity to comply with these Legal Terms; (4) you are not under the age of 13; (5) you are not a minor in your jurisdiction, or if a minor, you have parental permission; (6) you will not access the Services through automated or non-human means; (7) you will not use the Services for any illegal or unauthorized purpose; and (8) your use will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, or incomplete, we have the right to suspend or terminate your account.

4. User Registration

You may be required to register to use the Services. You agree to keep your password confidential and are responsible for all use of your account. We reserve the right to remove or change a username we determine to be inappropriate or objectionable.

You may register and sign in using your email and password, or using your Google account. If you sign up with Google, we receive your name and email address from Google to create your account; we do not receive or store your Google password.

Deleting your account: You can permanently delete your account and all associated data at any time from the Settings page in your account, or by emailing adiletbekmolda61@gmail.com. Deletion removes your profile data, saved shortlist, and account credentials from our systems. This action cannot be undone.

5. Purchases and Payment

We accept Visa, Mastercard, American Express, and PayPal, as well as locally relevant payment methods such as Kaspi for users in Kazakhstan.

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services, and to promptly update this information as needed. We may change prices at any time. All payments shall be in US dollars (or the local equivalent shown at checkout).

You agree to pay all charges at the prices in effect at the time of purchase, and you authorize us to charge your chosen payment method for those amounts. We reserve the right to refuse or limit any order, and to correct pricing errors even after a payment has been requested or received.

6. Subscriptions

Billing and Renewal

The 1 Month plan is a recurring subscription: your payment method is charged monthly and access continues until you cancel. The 3 Month and 6 Month plans are one-time payments that grant access for that fixed period from the date of purchase; they do not automatically renew.

Free Trial

We offer a 7-day free trial on the 1 Month subscription plan only. To start a free trial, you must provide a valid payment card. If you do not cancel before the trial period ends, your card will automatically be charged for the 1 Month plan, and your subscription will continue and renew monthly thereafter. The 3 Month and 6 Month plans are not eligible for a free trial and are charged in full at the time of purchase.

Cancellation

All purchases and charges are non-refundable.

Canceling during your free trial: If you cancel before the 7-day free trial period ends, you will not be charged.

Canceling after your free trial or for the 1 Month plan: You may cancel your subscription at any time. If you cancel after the trial has converted to a paid subscription, or if you cancel the 1 Month plan at any other time, no refund will be issued for the current billing period or for any amount already charged. Your access continues until the end of the period you already paid for. The 3 Month and 6 Month plans are one-time purchases and are not subject to cancellation; your access simply ends at the end of the purchased period.

You can cancel your subscription by logging into your account, selecting "Manage your plan" for the plan you want to cancel, selecting "Cancel your plan," choosing a reason for cancellation, and selecting "Done."

Fee Changes

We may, from time to time, make changes to subscription fees and will communicate any price changes to you in accordance with applicable law.

7. Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make them available. As a user, you agree not to:

The Services may invite you to chat, comment, or otherwise post content ("Contributions"). By creating or making available any Contributions, you represent and warrant that: the creation and distribution of your Contributions does not infringe any third party's rights; you own or have the necessary rights and licenses to submit your Contributions; you have consent from any identifiable individuals featured in your Contributions; your Contributions are not false, misleading, unsolicited advertising, obscene, harassing, or otherwise objectionable; and your Contributions do not violate any applicable law, including those protecting the privacy of others or the well-being of minors.

Any use of the Services in violation of the foregoing may result in termination or suspension of your rights to use the Services.

9. Contribution License

By posting Contributions to the Services, you automatically grant us an unrestricted, irrevocable, perpetual, non-exclusive, transferable, royalty-free, worldwide license to host, use, copy, reproduce, publish, translate, and distribute such Contributions for any purpose. This license applies to any form or technology now known or later developed. We do not assert ownership over your Contributions; you retain full ownership and are solely responsible for them. We have the right, at our sole discretion, to edit, recategorize, or delete any Contributions at any time without notice.

10. Third-Party Websites and Content

The Services may contain links to third-party websites or content not investigated, monitored, or checked for accuracy by us. We are not responsible for any third-party websites accessed through the Services, including their content, accuracy, or privacy practices. If you leave the Services to access a third-party website, you do so at your own risk and these Legal Terms no longer govern. Any purchases made through third-party websites are solely between you and that third party.

11. Services Management

We reserve the right, but not the obligation, to: monitor the Services for violations of these Legal Terms; take legal action against anyone who violates the law or these Legal Terms, including reporting to law enforcement; restrict, refuse, or disable access to any Contributions; remove content that is excessive in size or burdensome to our systems; and otherwise manage the Services to protect our rights and the proper functioning of the Services.

12. Privacy Policy

We care about data privacy and security. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms. The Services are hosted in Kazakhstan. If you access the Services from another region with data protection laws that differ from those in Kazakhstan, by continuing to use the Services you consent to having your data transferred to and processed in Kazakhstan.

We do not knowingly accept, request, or solicit information from children under 13, or knowingly market to children. If we learn that anyone under 13 has provided personal information without verifiable parental consent, we will delete that information as quickly as reasonably practical.

We respect the intellectual property rights of others. If you believe material on the Services infringes a copyright you own, notify us immediately using the contact information below. Please be advised that you may be held liable for damages if you make material misrepresentations in such a notice.

14. Term and Termination

These Legal Terms remain in full force while you use the Services. We reserve the right, in our sole discretion and without notice or liability, to deny access to and use of the Services to any person for any reason, including breach of any representation, warranty, or covenant in these Legal Terms or applicable law. We may terminate your account and delete any content or information you have posted at any time, without warning, in our sole discretion.

If we terminate or suspend your account, you are prohibited from registering a new account under your name or any other name. We may also pursue civil, criminal, and injunctive remedies as appropriate.

15. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Services at any time without notice, and have no obligation to update any information. We cannot guarantee the Services will be available at all times due to maintenance, technical issues, or other causes. We are not liable for any loss, damage, or inconvenience caused by your inability to access the Services during any downtime.

16. Governing Law

These Legal Terms are governed by and defined following the laws of Kazakhstan. Adilet Bekmolda and you irrevocably consent that the courts of Kazakhstan shall have exclusive jurisdiction to resolve any dispute arising in connection with these Legal Terms.

17. Dispute Resolution

Informal Negotiations

To expedite resolution and control costs, the parties agree to first attempt to negotiate any dispute informally for at least thirty (30) days before initiating arbitration.

Binding Arbitration

If the parties are unable to resolve the dispute informally, it shall be finally resolved by arbitration in accordance with the UNCITRAL Arbitration Rules. The number of arbitrators shall be one (1). The seat of arbitration shall be Almaty city, Kazakhstan. The language of proceedings shall be English. The governing law shall be the substantive law of Kazakhstan.

Restrictions

Any arbitration shall be limited to the dispute between the parties individually. No arbitration shall be joined with any other proceeding, and there is no right to arbitrate on a class-action basis or in a representative capacity.

Exceptions

The following disputes are not subject to informal negotiation or arbitration: disputes concerning intellectual property rights; disputes related to theft, piracy, invasion of privacy, or unauthorized use; and any claim for injunctive relief.

18. Corrections

There may be information on the Services that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors and update information at any time without prior notice.

19. Disclaimer

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT, INCLUDING AI-GENERATED FEEDBACK, AND ASSUME NO LIABILITY FOR ERRORS, INACCURACIES, UNAUTHORIZED ACCESS TO YOUR DATA, INTERRUPTIONS, OR ANY LOSS RESULTING FROM USE OF THE SERVICES. AI-generated feedback, scores, and recommendations are for informational purposes only and do not guarantee admission to any university.

20. Limitations of Liability

IN NO EVENT WILL WE OR OUR AGENTS BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.

21. Indemnification

You agree to defend, indemnify, and hold us harmless from any loss, damage, liability, or claim, including reasonable attorneys' fees, arising from: your Contributions; your use of the Services; your breach of these Legal Terms; your breach of any representations or warranties; your violation of the rights of a third party; or any harmful act toward another user.

22. User Data

We maintain certain data that you transmit to the Services for the purpose of managing performance, as well as data relating to your use of the Services. We perform regular routine backups of data, but you are solely responsible for all data you transmit. We have no liability to you for any loss or corruption of such data.

Retention: We retain your account data for as long as you maintain an account with us. If you delete your account, we permanently delete your profile data, saved shortlists, essays, and account credentials from our active systems. See our Privacy Policy for full details.

23. Electronic Communications, Transactions, and Signatures

Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and agree that electronic signatures, contracts, orders, and records satisfy any legal requirement that such communications be in writing.

24. Miscellaneous

These Legal Terms and any policies posted on the Services constitute the entire agreement between you and us. Our failure to enforce any right or provision shall not operate as a waiver. We may assign our rights and obligations at any time. If any provision is found unlawful or unenforceable, that provision is severable and does not affect the remaining provisions. No joint venture, partnership, employment, or agency relationship is created between you and us as a result of these Legal Terms.
